Charged for overnight delivery which I had missed the deadline for but still charged

Payed for an overnight delivery this did not happen delivery was 2 days but I was still charged for the overnight payment this was reported back via live chat but I was told I had missed the deadline.
Having missed the deadline surely a refund is the next step for the overnight charge!?!
